Overview:
With limited direction and supervision by the VP of Claims Legal, performs duties of legal counsel on a limited number of Austin area litigated workers'' compensation matters in the defense and representation of the Company. However, the position primarily requires providing on going legal research and advice to Claims both prior to and after the commencement of litigation on cases not being personally handled.
Responsible for the overall management of the outside inventory of litigated files from the Claims- Legal Department. Specific responsibilities include the coordination, management and monitoring of outside counsels cost-effectiveness in file handling.
In addition, the position requires the assistance in the development, planning and implementation of new projects and programs.
Responsible for reviewing proposed state regulations and procedures, and attending state regulatory hearings and legislative hearings to provide companys input for such regulations and procedures.
Under the general supervision of the Vice President, the candidate would perform a broad range of both administrative and managerial duties as well as the management of certain legal systems and system procedures.
Responsibilities:
The essential functions of this position include, but are not limited to, the following:

Defends a limited number of Austin area litigated and task only workers'' compensation cases.
*
Takes depositions, analyzes testimony and prepares and files related reports.
*
Represents the Company in appearances at hearings and conferences; prepares and files related reports.
*
Researches and prepares highly complex legal pleadings for cases before the Workers'' Compensation Appeals Board and on appeal as needed, requested or required.
*
Provides advice, training and recommendations on case handling strategies to representatives of the Claims Department and other departments as needed and requested.

Performs legal research at all levels, from advising clients through the appellate procedures.
*
Works productively and harmoniously with others on a consistent basis.

Recruits, interviews, selects, supervises and reviews the performance of all outside counsel lawyers. Recommends changes as necessary.

Develops, creates, implements and maintains objective performance measures to ensure quality control and cost effectiveness.

Creates coordinates and implements effective, professional and on-going programs developed to reduce the overall outside inventory on a regular basis with the use of Committee, Settlement Days and other related projects. These programs would include setting up of facilities, travelling to various locations, tracking of cases set, arranging actual meetings and settlement days with outside counsel, claims and mediators when necessary, monitoring events and tracking results.

Represent the companys interest and acts as a liaison between outside counsel and claims ensuring clear communication and identification of company needs and objectives.

Collects and analyzes statistical data, makes recommendations, uses technology and produces accurate, neat and timely reports to the Vice President on own initiative and with little direction as needed

Ensure compliance with developed reporting requirements and billing guidelines by outside lawyers.

Performs other job related duties as assigned.
Qualifications:
Education, Skills and Experience Requirements
*
Law school graduate and member in good standing of the State Bar.
*
Minimum Six years experience as Trial Attorney for the legal defense of workers'' compensation claims and/or civil litigation.
*
Ability to effectively communicate, both orally and in writing, in an articulate, persuasive, precise and professional manner.
*
Experienced with training small groups in current legal practices and procedures in the field of workers'' compensation defense and subrogation.
*
Ability to lift legal files, including documents and exhibits, up to a weight of 30 pounds.
*
Must be willing and able to travel extensively using all means of public transportation, as well as capable of prolonged automobile driving, in excess of three hours a day, to widely dispersed venues, as required.
*
Valid Driver''s License in good standing.
Attendance Requirements
Due to the nature of the needs in the office, regular and reliable attendance is required. Must be able to work at least 37.5 hours per week, Monday through Friday, and be available should a situation arise requiring extended hours.
